About Collaborative Divorce

Although "one size" never "fits all", collaborative divorce may be the most sophisticated, comprehensive, and economical solution for you. It combines the best aspects of adversarial divorce and mediation. Both parties have their own attorneys, but sign an agreement at the outset to cooperate in resolving all of the issues in their divorce case without litigation. Assisted by their lawyers, the parties work through a structured settlement in a series of conferences. On an "as needed" basis, economic issues are referred to a financial expert, and a therapist or counselor can be used to work through emotional issues that may arise, particularly with respect to child custody matters. At first glance it may seem that using up to four professionals would be overly expensive, but at the end of the day the opposite is usually true, especially when compared to the total cost of an adversarial proceeding. The end-product, a detailed settlement agreement that is a product of the parties' joint efforts, minimizes  the potential for post-judgment litigation and associated expense continuing into the future. More importantly, this process is the most effective for managing and minimizing the inevitable stress that comes with divorce.
