What Is a Prenuptial Agreement?

A prenuptial agreement is a contract by which spouses can agree that their assets, income and liabilities will be kept separate or shared. For the premarital agreement to be enforceable, both parties must disclose their income, liabilities and assets, the agreement must be voluntary, and both parties must have the opportunity to be represented by their own attorney, who may act as “review counsel.” Prenuptial agreements can be especially useful where both parties are gainfully employed, and in second marriages in which both parties have established careers and have accumulated some wealth.

Although you are certainly not expecting to get divorced, it’s a fact of life that divorces do occur. In that event, a well-drafted and properly-executed prenup can resolve most or all issues and save you stress and money down the line.
